Drug Possession Penalties in Massachusetts

Drug possession penalties in Massachusetts are broken up into categories for the different classes of drugs. Drugs with high potential for abuse are considered to be Class A substances and less dangerous substances are categorized as Class B, Class C or Class D.

The penalties for the various drug classes are as follows:

  • Possession of a Class A Substance- First time offenders can face up to two years in prison. Subsequent offenders could face a two and a half year sentence.
  • Possession of a Class B Substance- A first time offender could face up to 1 year behind bars, but a 2 offense could raise it to two years.
  • Possession of a Class C Substance- With your first or subsequent conviction you will be held for a minimum of two years.
  • Possession of a Class D Substance- When you are caught with this type of drug you could lose your driver's license for up to one year and you could have another two years added on if you were caught in or near a school zone.

Keep in mind that the amount of the drug you have in your possession could also affect the penalty that you face. If you have a significant amount on your person, then you could be suspected of drug distribution or drug sales. This could result in an increased penalty. Note that recently the state of Massachusetts changed the laws regarding possession of marijuana. If you are found with less than 1 oz. of marijuana you could simply face a civil infraction rather than criminal charges. Possession of 1 oz. or more of marijuana is still considered to be a criminal offense in Massachusetts.
