Salem Robbery Defense Lawyer

Have you been charged with Robbery? Call today.

Have you been charged with robbery in Massachusetts? This criminal offense is defined as larceny, taking something from a person using force. This means that the defendant took a tangible piece of property from another person and carried it away with the intent to never return it.

To constitute a robbery charge the suspect could either have taken the property while it was in the person's physical possession or the owner could have maintained control of the property if you hadn't threatened them with violence. This means that if they were not fearful of harm, then they could have prevented the theft from occurring.

With robbery charges there is also an aspect of violence, force or intimidation involved in the crime. According to Chapter 277 Section 39 of Massachusetts Law if the court is able to prove there was force, then proving fear is not necessary. The opposite is also true, if there was evident fear then proving force is not necessary.

If your or someone you know is facing criminal robbery charges, or you are being investigated for robbery or any other theft crime, then take swift legal action today. Call a skilled criminal defense lawyer from my firm without delay so that you can be informed of your rights and begin building a solid defense.

Penalties for Robbery in Massachusetts

The State has a few different laws regarding robbery crimes and the penalties range based on the specifics of the crime. The possible robbery charges in Massachusetts include:

Assault with Intent to Rob- This is a felony charge which could lead to 10 years in prison. It is important to note that with this charge you do not have to make physical contact or be successful in robbing or stealing in order to be charged.

Stealing and Instilling Fear- A good example of this would be a bank robbery which is considered to be a secure area. This charge could lead to a life sentence in prison.

Robbing Someone Age 60 or Older- This charge has a mandatory minimum sentence of 2 years and can go as long as life in prison.

Armed Robbery- When you commit a robbery crime using a dangerous weapon then you can face a mandatory minimum sentence of five years in prison for a first offense. The penalty goes up to a mandatory minimum of 15 years in prison for a second or third offense.

If you are facing any of the above charges, contact my Salem office today. I respond promptly to phone calls even at night or on the weekends.
