Shoplifting Penalties: Fighting to Avoid Prosecution

The severity of punishment for a shoplifting conviction will be based upon the value of the goods stolen and whether the shoplifter has any prior offenses on his or her criminal record. In Massachusetts, the penalties are as follows:

  • Less than $100 in goods and no prior offenses: Fine of up to $250
  • Up to $100 in goods and one prior offense: Fine between $100 and $500
  • Up to $100 in goods and two or more prior offenses: Fine of up to $500 and/or up to two years in jail
  • More than $100 in goods: Fine of up to $1,000 and/or up to two-and-a-half years in jail

The good news for first-time offenders and others accused of low-level theft crimes is that the state of Massachusetts offers pretrial diversion programs that allow a defendant to avoid criminal prosecution. These programs typically require the offender to repay the merchant for the value of the property stolen and then complete community service or probation. Once these terms are met, the court will drop the criminal charges. In cases where diversion is not possible, an offender may be allowed to enter a plea bargain and receive less severe sentencing in return.
