What is considered assault in Massachusetts?

To put it simply, you can be charged with assault if you demonstrate violent behavior and threaten to hurt someone. There are a few different types of assault and the crime of assault does not actually require you to physically touch or injure someone. The other person only has to believe that you plan to apprehend or injure them.

In Massachusetts there are four different types of assault charges, including:

  • Simple Assault- Misdemeanor
  • Assault- Misdemeanor
  • Aggravated Assault - Felony
  • Assault with a Dangerous Weapon- Felony

What are the penalties for assault in MA?

In Massachusetts assault is punishable for up to 2 ½ years in prison as well as a $1,000 fine. Aggravated assault is a felony offense which means that the penalties grow more severe. When charged with aggravated assault you could possibly be sentenced to 5 years in prison, 2 ½ years in a house of correction and/or pay a fine up to $5,000.

When you commit the assault crime while carrying a dangerous weapon, then the penalties grow significantly. For the most severe form of assault, you could be subject to 10 years of imprisonment along with 2 ½ years spent in the house of corrections. You can also be charged with mayhem if you commit the crime with the intent to permanently scar or disfigure the other person. If you are convicted of mayhem, then you could spend the next 20 years in prison.
