What is considered "kidnapping?"
Under Massachusetts General Laws Chapter 265 Section 26, it is unlawful to forcibly or secretly confine or imprison another person against his or her will without lawful authority. This includes everything from locking someone in a closet or basement against their will to transporting someone to a different location against their will.
Penalties for Kidnapping
Kidnapping is a felony and will result in a prison sentence of up to 10 years, or by imprisonment in the county jail for up to 2 years and a fine of up to $1,000. If a person kidnaps someone with the intent to exhort money or other valuables from another person (e.g. a ransom), then the prison sentence could be for life.
Commission of a kidnapping while armed with a deadly weapon or firearm will increase the prison sentence to a minimum of 10 years, or a jail sentence of up to 2.5 years. Combine this with intent to exhort money or valuables from someone else, and the prison sentence is 20 years to life. If the kidnapping involves a deadly weapon and serious bodily injury is inflicted, then the sentence increases to 25 years to life.
Kidnapping a child under the age of 16 will incur a prison sentence of up to 15 years.
